The Terms and Conditions of use presented below (the “Terms”) constitute the entire agreement between C-Direct Ltd (the “Site”), and any user of the Site. The use of the Site by any person attributes the user’s status user (the “User”), which implies their full and unconditional adherence to these Terms. Consequently, it is the User’s sole and exclusive responsibility to previously read the Terms and their corresponding modifications each time they access the Site. If at any time the User does not fully or partially agree with these Terms, they must immediately refrain from using the Site.
Acceptance of Terms
The User acknowledges that entering and using the Site expresses their express acceptance and adherence to the Terms and Conditions of the version published when the Site is accessed. If the User does not fully accept the Terms and Conditions, they must refrain from accessing and using the Site.
Access and Use of the Site.
Access to and use of the Site is free for Users. The User will not be obliged to register or register on the Site. The services offered through the Site are aimed at any person with legal capacity and legitimacy to be bound by the Terms and applicable legislation.
Object.
C-Direct Ltd makes the Site available to the User, whether it is a sponsored site, administered through a third party, or hosted by a third party, facilitating access to Users to various information provided by C-Direct Ltd or by persons linked to said information. Directly or indirectly (the “Contents”). The User acknowledges that the Site’s use does not imply any property rights over it or any of its elements or Contents. C-Direct Ltd reserves the right to modify totally or partially, at any time and without prior notice, the presentation, configuration, information, Contents, and in general, any part or aspect related directly or indirectly to the Site.
The User acknowledges that the descriptions of the services displayed on the Site are made in an illustrative manner and will have the standard, basic and straightforward scope and specifications that the market regularly offers, except when said scope and specifications are detailed.
Contents.
Correct use of the Contents. The User agrees to (a) use the Site and its Contents by applicable laws and public order, refraining from performing an act that undermines, deteriorates, disables, or damages the image and/or information disclosed by C-Direct Ltd or any other way injures the rights or interests of third parties, directly or indirectly linked to it; (b) not copy, disseminate, modify, reproduce, distribute or use in any way for profit or without profit the contents and elements used on the Site, unless you have the express written authorization of C-Direct Ltd; (c) not to modify or manipulate the brands, logos, commercial notices, commercial names and distinctive signs in general of C-Direct Ltd, the Site or the people directly or indirectly linked to C-Direct Ltd (unless you have your written authorization), (d) ) suppress, evade or modify the contents and elements used on the Site, technical protection devices, or any mechanism or procedure established on the Site.
The information generated through the Site for the User’s use and management is excluded from the above terms, which may be printed and/or copied for the interests that best suit the User.
The User acknowledges and accepts that the use of the Site and the Contents is under their exclusive and strict responsibility, so C-Direct Ltd will not be at any time and under any circumstances responsible for any damage or problem that may arise in the equipment of the computer (hardware) or computer programs (software) used by the User to access or navigate anywhere on the Site.
C-Direct Ltd declares that all the Contents, and the elements used on the Site, are duly registered and protected under the corresponding authorities and laws in Portugal. The User undertakes to respect all intellectual property rights over the Contents and the elements used on the Site owned by C-Direct Ltd.
Sites and Content outside the Site and the Contents.
C-Direct Ltd may use its right to publish any informative material and/or of sites or subsites owned by third parties linked or not to C-Direct Ltd, which it considers to be of interest to Users. Notwithstanding the preceding, C-Direct Ltd disclaims any responsibility for the access and/or use that the User makes of the information contained therein and/or the use, origin, and destination of the information that arises from different links (link, hyperlink, “link”).
Any publication made within the Site does not generate an obligation to third parties to pay for promotion, magazine, and/or the information and/or image management unless there is a contract previously signed by the parties.
Denial and withdrawal of access to the Site and/or the Contents.
C-Direct Ltd reserves the right to deny or withdraw access to the Site and / or the Contents at any time and without prior notice, to the User or Users who totally or partially breach the terms and conditions established herein and / or who take actions or acts tending to: (i) “besiege” or otherwise harass or annoy C-Direct Ltd staff or employees; (ii) impersonate a representative or employee of C-Direct Ltd, making false or otherwise erroneous statements of your relationship with C-Direct Ltd or collect or store personal data of other users in relation to prohibited conduct and activities; (iii) falsify headers or manipulate identifiers of the Site in order to hide the origin of the content transmitted by the Site; (iv) upload, publish, email, transmit or otherwise provide any content with respect to which you do not have the right to transmit by virtue of the terms contained in the Industrial Property Law (“LPI”), Federal Law of Copyright (“LFDA”), and the Federal Law on Protection of Personal Data Held by Private Parties (“LFPDP”) or contractual relationships protected by nondisclosure agreements; (v) upload, post, email, transmit or otherwise provide materials that contain computer viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of software, hardware or telecommunications equipment connected to the Site; (vi) use the Site in a way that could damage, disable, reload or alter C-Direct Ltd’s servers or network connections, ignore requirements, procedures, policies or regulations of networks connected to the Site that could interfere with the use and enjoyment of the Site by any third party; and / or (vi) unauthorized access to the Site, accounts, computer systems or networks connected to C-Direct Ltd’s servers, through hackers’ own attacks, password cracking or any other method, neither obtain nor try to obtain materials or information by any means that is not intentionally offered through the Site.
The User agrees to indemnify C-Direct Ltd and keep C-Direct Ltd and its officials, agents, employees, partners, and licensors safe from any claim or demand, as well as to cover reasonable attorney fees promoted by any third party against C-Direct Ltd due to the content that the User sends, publishes, transmits or provides in a way other than that provided on the Site. The preceding without prejudice to the right of C-Direct Ltd, to take the necessary legal actions to claim the damages that said efforts by the User could cause.
Responsibility regarding the contents.
C-Direct Ltd does not assume any responsibility derived, but not limited to: (i) the use that the User may make of the materials on this Site or the linked “Website”, whether prohibited or permitted, in violation of the intellectual and / or industrial property rights of the contents of the website or of third parties; (ii) any damages and losses to the User caused by normal or abnormal operation of the search tools, the organization or the location of the content and / or access to the Site and, in general, errors or problems that arise generate in the development or instrumentation of the technical elements that the Site or program provides to the User;(iii) the contents of those pages that the User can access from links included in the Site, whether authorized or not; (iv) the acts or omissions of third parties, regardless of the relationship that said third parties may have with C-Direct Ltd; (v) the access of minors to the contents included in the Site, as well as the sending of personal information that they may carry out; nor (vi) the communications or dialogues in the course of the debates, forums, chats and virtual communities that are organized through or around the Link Site, nor will it be liable, therefore, for any damages suffered by the User as a result of said communications and / or dialogues. Likewise, C-Direct Ltd will not be responsible in any way when there are: (i) errors or delays in accessing the Site when entering the data in the request form, the slowness or impossibility of receipt by the recipients of the confirmation of the request, or any anomaly that may arise when such incidents are due to problems in the Internet network, fortuitous events or force majeure or any other unforeseeable contingency beyond C-Direct Ltd; (ii) failures or incidents that may occur in communications, either by deleting or by incomplete transmissions, so that it is not guaranteed that the services of the Site are constantly operational; (iii) of the errors or damages produced to the Site due to a misuse of the service by the User; (iv) of non-operability or problems in the email address provided by the User to send the confirmation of the request made. In any case, C-Direct Ltd undertakes to solve the problems that may arise and to offer all the necessary support to the User to reach a quick and satisfactory solution to the incident.
Access and stay on the site.
The User is solely responsible to The Provider and/or any third party, regarding their conduct when accessing, consulting, and providing information to the Site, namely: (i) the consequences that may arise from a user, for or illicit or contrary effects to this document, of any content on the Site, prepared or not by C-Direct Ltd, published or not under its name officially; and (ii) the consequences that may arise from the use contrary to the content of the Terms that is harmful to the interests or rights of third parties, or that in any way may damage, disable or impair the Site or its services or prevent regular enjoy other Users.
